{"id":4046,"date":"2023-02-01T07:54:50","date_gmt":"2023-02-01T12:54:50","guid":{"rendered":"https:\/\/wellscountyswcd.org\/?page_id=4046"},"modified":"2026-09-22T14:24:16","modified_gmt":"2026-09-22T18:24:16","slug":"construction-stormwater-generalpermit-csgp","status":"publish","type":"page","link":"https:\/\/wellscountyswcd.org\/construction-stormwater-generalpermit-csgp\/","title":{"rendered":"Construction Stormwater General<br>Permit (CSGP)"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The purpose of the 327 IAC 15-5 (Rule 5) is to reduce pollutants, principally sediment as a result of soil erosion, in storm water discharges into surface waters of the state.&nbsp; The requirements of Rule 5 apply to all persons who are involved in construction activity (which includes clearing, grading, excavation and other land disturbing activities) that results in the disturbance of one (1) acre or more of total land area.&nbsp; If the land disturbing activity results in the disturbance of less than one (1) acre, but is part of a larger common plan of development or sale (such as the development of a subdivision or industrial Park), it is still subject to storm water permitting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.in.gov\/idem\/stormwater\/construction-land-disturbance-permitting\/\">IDEM: Storm Water Permitting: Construction \/ Land Disturbance Permitting<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">******** The Wells County Soil &amp; Water Conservation District no longer reviews CSGP&#8217;s. ************<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Please refer to the guidance below regarding projects that require permit coverage under the CSGP.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Projects in Wells County outside of the City of Bluffton:<\/strong> IDEM has primary regulatory authority under the CSGP. In order to obtain permit coverage under the CSGP, a SWP3 must be submitted to and accepted by IDEM, and an NOI application must be submitted to IDEM thereafter. All SWP3 and NOI submittals must be made to IDEM electronically via the Regulatory ePortal (<a href=\"https:\/\/waterquality.idem.in.gov\/ncore\/external\/home\" target=\"_blank\" rel=\"noopener\">https:\/\/waterquality.idem.in.gov\/ncore\/external\/home<\/a>).\n<ul class=\"wp-block-list\">\n<li>If you receive inquiries asking how to submit the SWP3, please direct them to submit to IDEM via the Regulatory ePortal as part of a Construction Stormwater Pollution Prevention Plan Project Profile service request.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Projects that are owned\/operated by the City of Bluffton:<\/strong> IDEM has primary regulatory authority under the CSGP, and the process to obtain permit coverage under the CSGP is the same as outlined above.<\/li>\n\n\n\n<li><strong>Projects that are regulated by the City of Bluffton MS4 (typically privately owned projects in City limits):<\/strong> The City of Bluffton MS4 has primary regulatory authority via local stormwater ordinance(s), and permit coverage under the CSGP is also required. The SWP3 must be submitted to and reviewed by the local MS4 in accordance with their local ordinances(s); IDEM does not perform the plan review. Once the SWP3 has been accepted by the MS4, an NOI application with proof of plan review from the MS4 must be submitted to IDEM via the Regulatory ePortal.
